Privacy Policy

Draft pending legal review. This policy describes how the
site works today. It has not yet been reviewed by an attorney, and some details below are
still being finalised.
Pete's Clam Stop has been on the Coney Island boardwalk since 1975. This page explains,
plainly, what this website collects, why, and what we do with it. If something here doesn't
match what you experienced, tell us — our contact details are at the bottom.
What we collect, and when
We only collect information when you type it in. There is no account, no login, and no profile.
When you place an order
Ordering starts by scanning the printed QR code at your table — you can't order from
the open web. On that form we collect:
- Your name — required, so we can call your ticket.
- Your phone number and/or email — optional. You can
leave both blank and still order.
- A free-text note, if you write one (an allergy heads-up, "no onions", that kind of thing).
- Your items, your ticket number, and the date and time of the order.
- The IP address the order came from.
When you join The First Dozen
We collect your name and your phone number and/or email address. Club signup requires you
to check a marketing consent box.
When you consent to marketing
We save a record of the consent itself: the date and time, the exact wording you were shown,
which page you were on, and the IP address you submitted from. That record exists so we can
show you later exactly what you agreed to.
Automatically
We record basic activity: page views, QR code scans, and order submissions. We use IP
addresses to slow down spam and abuse — those rate-limiting IPs are stored only as
salted hashes, a scrambled one-way form we can compare against but cannot turn
back into your address.
Why we collect it
- Your name: to make and call your order.
- Your phone or email: so we can reach you if something's wrong — an
item is out, we can't read your note, you walked off before your ticket came up.
- Marketing: only if you checked the box. If you didn't, we don't send you anything.
- Analytics: to see how busy the window is, whether the QR codes are working,
and where people get stuck.
We do not build advertising profiles, and we do not track you across other websites.
Payment
You pay in person, at the counter. This website never asks
for, sees, or stores a card number, expiry date, CVV, or bank details. If a page ever asks you
for card details in our name, it is not us — please tell us.
Marketing, and how to stop it
Checking the marketing box gives us permission to contact you about specials, seasonal hours,
and club offers using the contact details you gave us.
Two honest notes:
- Email and text messages are separate things. Agreeing to one is not
agreeing to the other. If you gave us only an email, we would only email you. If you gave
us a phone number and agreed to texts, your carrier's message and data rates may apply.
- We are not currently sending anything. As of the date at the top of this
page, we have not built email or text sending. We are collecting consent so we can start
later, and when we do it will only go to people who opted in.
To opt out, any time:
- Use the unsubscribe page. Messages we send will include a link
that identifies you, so it works in one click.
- Or call the shop and ask us to take you off the list.
- Or reply STOP to a text, once texting exists.
Opting out of marketing does not affect an order you've already placed — we may still
contact you about that specific order.
Cookies and analytics
We use a small amount of browser storage to keep your order session working after you scan the
QR code — without it, the order page can't remember what's in your basket. We count page
views, QR scans, and order submissions in aggregate. We do not use third-party advertising
cookies, ad networks, retargeting pixels, or data brokers.
Who else can see your information
- Our staff, through the shop's staff portal, to run orders and the club list.
- Our web host, Hostinger, which stores the site and its database as part of hosting it.
- Nobody else. We do not sell your information, and we do not rent, trade, or
share it for anyone else's marketing. The only other case would be if we were legally
required to hand something over — for example, a valid court order.
Pete's Clam Stop (1320 Surf Avenue) and Williams Candy (1318 Surf Avenue) are
next door to each other, run by the same owner, and share one staff portal and one database. If
you gave your details to one shop, staff at the other may be able to see them in that shared
system. We don't think you should have to guess about that, so we're saying it plainly.
How long we keep it
- Order records: [RETENTION PERIOD TO BE CONFIRMED] for our business records, then deleted.
- Club and marketing contacts: until you opt out or ask us to delete you.
- Consent records: for as long as we hold your contact details, plus
[RETENTION PERIOD TO BE CONFIRMED] after you opt out — the record of your consent is
the proof that we had permission.
- Analytics and hashed IPs: [RETENTION PERIOD TO BE CONFIRMED].
Children
We sell food that kids love, and kids are absolutely welcome at the window. But this website is
meant for adults.
We do not knowingly collect personal information from children under 13. The order form and the
club signup are intended to be filled out by a parent, guardian, or another adult. Please don't
have a child enter their own name, phone number, or email.
If you believe a child under 13 gave us information, contact us and we will delete it. If a
child is with you and you enter your own contact details to order for them, that's fine —
that's your information, not theirs.
Asking for your data, or asking us to delete it
You can ask us to tell you what we have about you, correct something that's wrong, delete what
we have, or stop sending you marketing.
Contact us at [PRIVACY CONTACT EMAIL TO BE CONFIRMED], or call (718)
372-0302, or come by the shop. We may need to ask a question or two to confirm you're really
you before we hand over or delete a record. We'll respond within [RESPONSE WINDOW TO BE CONFIRMED].
If you ask us to delete your order history, note that we may need to keep a minimal record for
tax and accounting purposes.
Changes to this policy
If we change how we handle your information, we'll update this page and change the date at the top.
